1. Agreement to these Terms

These Terms of Service ("Terms") form a binding agreement between you and Mylus and govern your access to and use of the Mylus application, websites, and related services (together, the "Service").

By creating an account, signing in, or otherwise using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy and Health & Fitness Disclaimer, which are incorporated here by reference. If you do not agree, do not use the Service.

2. Who may use the Service

You must be at least 18 years old to create an account and use the Service. The Service is not offered to, and may not be used by, anyone under 18 — there is no exception for parental or guardian consent.

By using the Service you represent that you are at least 18 and that the information you provide is accurate and complete.

3. What Mylus provides

Mylus is a personalized sports-science decision-support tool. It uses your profile (such as body data, injury history, training level, and goals) together with biomechanics and exercise-science references to generate individualized training plans and to adjust them based on your feedback over time.

4. Your account

You can create an account using email or a supported third-party sign-in provider such as Sign in with Apple or Google. You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account.

You agree to provide accurate profile and health information and to keep it up to date, since the quality and safety of the plans Mylus generates depend on it. Notify us promptly of any unauthorized use of your account.

5. Health, safety, and assumption of risk

Physical training carries inherent risks, including muscle soreness, injury, and in rare cases serious harm. You should obtain clearance from a qualified physician before beginning any new training program, particularly if you have a pre-existing condition, injury, or other health concern.

You are solely responsible for exercising within your own capabilities and for stopping any activity that causes pain, dizziness, or distress. To the fullest extent permitted by law, you knowingly and voluntarily assume all risks associated with your use of the Service and any training you perform.

6. Subscriptions, plans, and payments

Parts of the Service may be offered on a free basis with usage limits, and other parts may require a paid subscription. Where subscriptions are sold through a third-party app store, billing, renewals, and cancellations are governed by that store's terms in addition to these Terms.

Unless required by law or expressly stated otherwise, payments are non-refundable. Pricing, quotas, and features may change; we will provide notice where required.

7. Acceptable use

You agree not to misuse the Service, including by: attempting to access accounts or data that are not yours; reverse-engineering, scraping, or overloading the Service; uploading unlawful, infringing, or harmful content; or using the Service to provide medical advice to others or in any way that violates applicable law.

We may suspend or limit access to protect the Service, our users, or third parties.

8. Intellectual property

The Service, including its software, models, content, and trademarks, is owned by Mylus or its licensors and is protected by intellectual-property laws. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the Service as an end user, in accordance with these Terms and any paid plan you purchase. You may not resell, redistribute, sublicense, or commercially exploit the Service itself.

No rights are granted except as expressly set out here.

9. Your content and feedback

You retain ownership of the information and content you submit. You grant Mylus a worldwide, royalty-free license to host and process that content solely as needed to provide the Service to you — for example, to generate and adjust your training plans — consistent with the Privacy Policy. We do not use your content to train machine-learning models.

If you send us suggestions or feedback, we may use them without restriction or obligation to you.

10. Third-party services

The Service relies on third parties (for example, authentication and cloud-infrastructure providers). Your use of those services may be subject to their own terms and privacy policies, and we are not responsible for third-party services we do not control.

11. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that any training outcome will be achieved.

12. Limitation of liability

To the fullest extent permitted by law, Mylus and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or relating to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us for the Service in the twelve months before the claim, or USD 50. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

13. Indemnification

You agree to indemnify and hold harmless Mylus and its affiliates from any claims, damages, liabilities, and expenses arising out of your misuse of the Service or your violation of these Terms or applicable law.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if necessary to protect the Service or its users. Provisions that by their nature should survive termination will survive.

15. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will provide reasonable notice, for example within the app. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.

16. Governing law and disputes

These Terms are governed by the laws of the People's Republic of China, without regard to conflict-of-laws rules. Disputes will be resolved in the courts of that jurisdiction, except where mandatory local law gives you the right to bring proceedings elsewhere.
